Settlement imposed a civil penalty over charitable solicitation calls

InfoCision, Inc., an Akron, Ohio-based company, made calls nationwide for charitable organizations. The Federal Trade Commission alleged that in some campaigns its telemarketers told consumers at the beginning of a call that they were not asking for a donation. The telemarketers later asked consumers to mail or hand-deliver donation requests to family members, friends, or neighbors. In many cases, the FTC said, telemarketers also asked consumers to donate, typically between $10 and $50.

The FTC charged InfoCision with making false or misleading statements to induce charitable contributions in violation of the Telemarketing Sales Rule. The proposed order bars the company from making false or misleading statements intended to induce payment for goods or services or a charitable contribution. For outbound charitable solicitation calls, it requires disclosure of the charity’s name, the call’s solicitation purpose, and whether the requested contribution is money or another item of value.

The order imposes a $250,000 civil penalty and includes recordkeeping and monitoring requirements for future compliance. The Department of Justice filed the complaint and proposed order on the FTC’s behalf in the U.S. District Court for the Northern District of Ohio on January 10, 2018.
