Court rulings and settlements ended a robocall operation
The FTC’s June 2018 Operation Main Street release identified PointBreak Media as an action filed in May 2018. It said the FTC charged a Florida-based scheme with deceiving small business owners through robocalls. According to that release, the callers claimed to represent Google, falsely threatened businesses with removal from Google search results, and falsely promised first-place or first-page placement in those results. The supplied release does not give a price for the offered service or a total amount paid or lost.
The supplied case description reports that, at the FTC’s request, a U.S. district court in Florida granted summary judgment against two individuals in May 2019. It also says the court approved six settlement agreements involving 11 defendants and entered a default judgment against the remaining seven defendants. The description says these actions officially ended the Pointbreak Media robocall scheme.
In August 2020, according to the case description, the FTC returned more than $70,000 to consumers defrauded through the scheme. The text does not identify that refund total as an amount a court or regulator ordered paid.
What is not established: The case description does not identify which of the reported dispositions applied specifically to Pointbreak Media, LLC. It also does not state whether any settlement included an admission of wrongdoing.
