The FTC challenged medical certification and review-site claims

SmartClick Media LLC, doing business as Doctor Trusted, sold seals and certificates to websites offering health-related products and services. According to the FTC complaint, the program operated from June 2013 through October 2015 and sold seals to 800 websites. The certificates told visitors that an independent physician had carefully evaluated the products, information, claims, terms, and policies and found them trustworthy and safe for purchase.

The FTC alleged that the two freelance doctors only conducted superficial reviews. It said they did not evaluate products or determine whether advertising claims were supported. The agency also alleged that SmartClick operated lifestyle blogs and review sites, including betterlivingjournal.org, that appeared independent while functioning as advertising vehicles. The defendants received commissions when consumers clicked or purchased advertised products.

A proposed stipulated final order would bar misrepresentations about expert review, certification, organizational status, and whether a publication is independent. It also requires disclosures when content is advertising or paid placement and when a material connection exists. The order imposed a $603,588 judgment, partially suspended upon payment of $35,000.
