Placement-service claims led to a consent agreement
ABCSP, Inc., which the FTC release says also did business as Always Best Care, offered consumers free help obtaining placements at senior-care facilities. The facilities paid the company for placements, and ABCSP operated through a nationwide network of franchisees.
The FTC alleged that ABCSP misrepresented how its recommendations were developed. Its advertising said care coordinators were local, had personally viewed virtually all assisted-living communities in a consumer’s area, and would match clients with appropriate options based on individual needs, custom screening, and available budgets. According to the complaint, ABCSP typically did not know which assisted-living facilities and residential care homes had contracts with its franchisees. In numerous regions, the recommendations were not based on the personal knowledge of ABCSP personnel or agents.
ABCSP agreed to a proposed consent order barring false or unsupported representations about its placement services. The release said the order would apply for 20 years. The agreement was subject to a 30-day public comment period before the Commission decided whether to make it final.

The FTC release states that an administrative complaint is not a finding that the law was violated. It also states that a consent order is for settlement purposes only and does not constitute an admission by the respondent.
