Telemarketing action ended in settlement and refunds
The FTC alleged that Advertising Strategies and related companies telemarketed bogus online investment opportunities under names including Building Money, Prime Cash, Wyze Money, and Titan Income. The offers generally involved buying or investing in e-commerce websites or joining a profit-sharing program involving credit card companies and e-commerce websites. Some consumer payments exceeded $20,000. The complaint also charged the defendants with calling numbers on the National Do Not Call Registry. The FTC said many consumers were seniors or military veterans living on fixed incomes.
A federal court halted the operation and froze the defendants’ assets while the case was pending. In March 2017, the court entered a stipulated final order that banned the defendants from telemarketing, marketing investment opportunities, and benefiting from consumers’ personal information. The order imposed a $25 million judgment, partially suspended when the defendants surrendered assets. The settlement required approximately $7.5 million in consumer redress.
In March 2019, the FTC announced 10,365 refund checks totaling $7,097,257. The checks averaged $684 and were funded by assets surrendered under the settlement.
