Work-at-home earnings claims led to a sales ban and payments
The Federal Trade Commission alleged that Moda Latina BZ Inc. and its owners, Esther Virginia Fernandez Aguirre and Marco Cesar Zarate Quíroz, targeted Latina consumers through Spanish-language television advertising. The company sold a work-at-home opportunity involving the resale of luxury products such as brand-name perfumes.
According to the complaint, the defendants falsely promised large profits, including earnings of up to $1,000 a week. The FTC also alleged that their telemarketers routinely threatened consumers in violation of the Telemarketing Sales Rule. The Moda Latina paragraph in the FTC’s Operation Income Illusion announcement states that, from March 2017 through August 2020, the defendants took more than $7 million from consumers who bought the opportunities but did not earn the promised income.
The settlement permanently prohibits the defendants from selling any service or product presented as a way for consumers to make money. It also bars deceptive claims about the risk or money-making potential of goods or services and prohibits further Telemarketing Sales Rule violations.
The settlement imposed a $7,000,489 judgment that was partially suspended because of the defendants’ inability to pay. Zarate and Fernandez were each required to pay $20,000, while the corporate defendant was in bankruptcy proceedings. The full judgment would become payable if the defendants were found to have misrepresented their financial condition.
