Two separate problems

Vision Path, the New York company selling direct-to-consumer Hubble contact lenses, agreed in January 2022 to pay penalties and redress totaling $3.5 million.

The first set of charges concerns the Contact Lens Rule. The FTC alleged the company failed to obtain prescriptions, failed to properly verify prescription information, and substituted Hubble lenses for the lenses actually prescribed. A contact lens is a regulated medical device fitted to a specific eye, which is why that rule exists.

The second concerns the reviews. The FTC alleged the company violated the FTC Act by failing to disclose that many reviews of Hubble lenses were not written by unbiased consumers. They were written by reviewers who were compensated, and in at least one instance by one of the company’s own executives.

What is not established

The only supplied document is a short case page summary. It does not give the number of consumers affected, the period covered, the split between penalties and redress, or the specific reviews at issue, so none of that appears here. A settlement resolves allegations without any admission or finding of wrongdoing.
